1. Acceptance of Terms

• By downloading, installing, or using either ParkIN24 application, you confirm you are at least 18 years old and legally capable of entering into a contract.
• These Terms constitute a legally binding agreement between you and ParkIN24.
• We may update these Terms from time to time. Continued use of our Services after changes constitutes acceptance of the new Terms.
• Partners (space owners) must additionally agree to the Partner-specific terms in Section 5 before listing any parking space.

2. Our Services

ParkIN24 provides a technology platform that connects drivers seeking parking with property owners ("Partners") who have available parking spaces. ParkIN24 is a marketplace platform and is not itself a parking space operator.

• Real-time parking spot discovery via interactive map.
• Booking and reservation management for hourly and monthly parking plans.
• QR-code based entry verification at partner locations.
• Payment processing via Razorpay (UPI, cards, net banking).
• In-app messaging between drivers and partners.
• Earnings management, wallet, and payout services for partners.
• Notifications, booking history, and receipts.

ParkIN24 reserves the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

3. User Accounts

• You must register using a valid Indian mobile number. Authentication is via OTP (one-time password).
• You are responsible for maintaining the security of your account. Do not share your OTP or account credentials with anyone.
• You must provide accurate, current, and complete information during registration and keep it updated.
• Each phone number may only be associated with one account per app (Driver or Partner).
• OTP requests are limited to 5 per hour per phone number to prevent abuse.
• ParkIN24 reserves the right to suspend or delete accounts that violate these Terms.

4. Driver Terms

4.1 Bookings

• When you book a spot, a contract is formed between you and the Parking Partner. ParkIN24 facilitates this transaction.
• Your QR code is personal and must not be shared. It is valid only for your booked time period and vehicle.
• You must arrive within 15 minutes of your booking start time, or the spot may be released at the Partner's discretion.
• Hourly bookings are billed per minute of actual occupancy.

4.2 Vehicle Responsibility

• You are responsible for your vehicle and any damage it may cause at the parking location.
• ParkIN24's CCTV monitoring captures footage for security purposes only. This does not constitute an insurance guarantee.
• ParkIN24 is not liable for theft, vandalism, or damage to your vehicle while parked, except where caused by our platform's direct negligence.

4.3 Conduct at parking locations

• You must follow all rules posted at the parking location by the Partner.
• No dangerous goods, illegal items, or non-roadworthy vehicles may be parked.
• Overstaying your booked time may result in additional charges and account penalties.

5. Partner Terms (Space Owners)

5.1 Listing your space

• You must complete KYC verification (Aadhaar + PAN) before listing any parking space. Listings without verified KYC will not appear in the app.
• You must have legal right (ownership or permission) to offer the parking space for rent.
• All listing information (location, capacity, pricing, photos, availability) must be accurate. Misleading listings will be removed immediately.
• You must ensure your parking space is accessible, safe, and matches your listing at all times during booked periods.

5.2 Earnings & Commission

• ParkIN24 retains a 15% platform fee from each booking. You receive 85% of the total booking value.
• Earnings are credited to your ParkIN24 Wallet after each completed booking.
• Withdrawals can be requested once your wallet reaches a minimum balance of ₹100.
• Payouts are processed to your registered bank account within 24 hours of request approval.

5.3 Partner obligations

• You must honour all bookings confirmed by ParkIN24. Repeated cancellations may result in account suspension.
• You must maintain CCTV coverage at your listed location.
• You must respond to driver messages within a reasonable time.
• You are responsible for the physical safety and maintenance of your parking space.

5.4 Gamification & Loyalty

• Partners participate in the Loyalty Tier system (Bronze → Silver → Gold → Platinum) based on bookings completed and ratings received.
• Loyalty tier benefits (priority placement, referral bonuses) are subject to change at ParkIN24's discretion.
• Manipulation of the rating or referral system is strictly prohibited and will result in immediate account termination.

6. Payments & Refunds

6.1 Payment processing

• All payments are processed by Razorpay, a PCI DSS-certified payment gateway.
• Payment verification is completed server-side. ParkIN24 verifies Razorpay payment signatures before confirming any booking.
• You consent to Razorpay's Terms of Service for payment transactions.

6.2 Refund policy

• Driver cancellation: Cancellations made more than 30 minutes before the booking start time are eligible for a full refund. Cancellations within 30 minutes receive no refund.
• Partner cancellation: If a Partner cancels a confirmed booking, the driver receives a full refund plus a compensation credit to their wallet.
• Platform error: If a booking fails due to a ParkIN24 platform error (e.g., double-booking), you receive a full refund within 24 hours.
• Refunds are processed to your original payment method within 5-7 business days.

7. Prohibited Conduct

You must not:

• Provide false information during registration or KYC verification.
• Use the platform for any illegal purpose.
• Attempt to circumvent payment processing (e.g., direct cash arrangements to avoid platform fees).
• Manipulate reviews, ratings, or referral systems.
• Share your QR booking code with another person or vehicle.
• Use automated bots, scrapers, or other unauthorized tools to access our Services.
• Harass, abuse, or threaten other users through the in-app chat.
• Reverse-engineer or attempt to extract source code from our applications.

Violations may result in immediate account suspension and legal action where applicable.

8. Limitation of Liability

• ParkIN24 is a marketplace platform. We are not responsible for the actions or omissions of drivers or parking partners.
• To the maximum extent permitted by law, ParkIN24's total liability to you for any claim shall not exceed the amount you paid to us in the 3 months prior to the claim.
• ParkIN24 is not liable for indirect, incidental, special, or consequential damages including loss of profits, data loss, or vehicle damage.
• We are not responsible for third-party services (Razorpay, Google Maps, Firebase) that we integrate with.

9. Termination

• You may delete your account at any time by contacting hello@parkin24.com.
• ParkIN24 may suspend or terminate your account without notice if you breach these Terms.
• Upon termination, your right to use the Services ceases immediately. Pending payouts for Partners will be processed within 30 days of account closure.
• Clauses relating to liability, governing law, and dispute resolution survive termination.

10. Governing Law & Disputes

• These Terms are governed by the laws of India, specifically those applicable to the state of Tamil Nadu.
• Any disputes shall first be attempted to be resolved through good-faith negotiation.
• If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu.
• The Consumer Protection Act, 2019 (India) applies to all consumer disputes.
